Ultimately depends if the girl want to sue you. or anyone in the public wants to do it. The IO can choose to ignore the case, it'll just add paperwork for them.

guy shoot upskirt, girl + witness saw, police come, police will escort guy to cantonment, girl will have to take cab there asap to lodge report. in 'strict terms' upskirt is 'quite mild', and sometimes up to IO to pass judgement and most likely girl will have to go magistrate court to 'sue' the guy. in the end, lots of work for the girl and for police and depends on judge, punishment can be weeks to months in jail if sentence.

most cases won't get so far. pleading guilty and be remorseful does help. not having a ton of upskirt videos in your phone helps too!
