HE PAYS HER $30,000 TO FORGIVE HIM Businessman rapes best mate's drunk girlfriend, then admits crime in letter and begs for mercy THEY had been friends for nearly 20 years - since they were in national service. By Maureen Koh 12 November 2007 THEY had been friends for nearly 20 years - since they were in national service. But one night of drinking changed all that. Incredibly, one pal allegedly had sex in the dark with his best friend's drunk girlfriend before she realised her mistake. And this took place while the victim's boyfriend was sleeping outside the master bedroom. In her drunken stupor, the woman had mistaken the man as her boyfriend when he climbed into the bed. By the time the truth hit her, it was too late. The three of them were torn asunder when it all came out into the open. A confession was allegedly written and compensation paid. But the couple remained deeply troubled, and initially declined to talk when approached by The New Paper on Sunday. It was a humiliation that no man could accept, the boyfriend said. He gave his name only as Mr Lee. He finally decided to talk about it to warn others not to take chances with alcohol and intimate situations. Mr Lee, 40, a sales executive, said: 'There was no excuse for that to happen. I was so furious that I wanted to lodge a police report against him.' But his friend, a married businessman in his 40s, went down on his knees, cried and begged profusely for the couple's forgiveness. In the end, it was the woman who did not want to make the matter worse. Mr Lee said: 'He was lucky because my girlfriend, who has a soft heart, decided to forgive him.' But one condition of the 'settlement' was that the man had to write a letter of apology detailing what he did in six points. One mentioned the cash compensation of $30,000 to Mr Lee's girlfriend, who is in her 30s. SIMILAR CASE The events bear a similarity to a recent case in Malaysia where a woman had sex with a lodger she mistook for her husband. In Mr Lee's case, he said his then-best friend had invited them, among others, to a gathering at his flat in the north-east. 'We were playing cards, drinking and reminiscing about the past,' he said. His friend was 'a good host and there was plenty of beer and red wine to go around'. By 2.30am, everyone had left except the host and Mr Lee and his girlfriend. 'My girlfriend had consumed too much liquor and she was quite drunk. It was then he suggested that we sleep over,' Mr Lee said. The businessman had offered his girlfriend the use of the master bedroom, saying it was fine since his wife was not in town. Mr Lee said they continued to drink and chatted for a while more. 'As I was also tipsy and exhausted, I fell asleep in the living room,' he recalled. Mr Lee claimed that at about 5am, his friend roused him from sleep. 'He had a strange expression on his face - a mixed look of discomfort and guilt. He just kept muttering the word 'sorry'.' Mr Lee was baffled. 'I didn't understand what he was trying to tell me and I kept asking him to make himself clear,' he said. It was then the businessman pointed to the master bedroom. Mr Lee said: 'When I pushed open the door, I was so shocked to see my girlfriend completely naked. She was crouching by the side of the bed and bawling her eyes out.' The man had apparently entered the room at around 4.30am. Mr Lee claimed: 'My girlfriend said he began undressing her the minute he entered the room. 'He then climbed onto the bed and started to get intimate with her.' In her drunken state, Mr Lee's girlfriend had mistaken the businessman to be him. PITCH DARK He added: 'It was pitch dark in the room. They petted for a while and it was only when they had intercourse that my girlfriend realised to her horror the man was someone else.' The girlfriend was so repulsed that her mind went blank. She froze for a moment before bursting into tears. That was when the businessman scurried out to call Mr Lee. Initially, the girlfriend had suspected Mr Lee of conspiring with the businessman, Mr Lee said. The couple had been dating for about six months and had discussed marriage plans. The girlfriend said: 'They were friends for nearly 20 years. If they are really good brothers, how could the man have done this to his best friend's girlfriend? 'And to commit such an act in his own home, on his matrimonial bed?' When the girlfriend was convinced that it was not a set-up, she softened. Mr Lee said: 'She even asked me not to pursue the matter and not to tell the man's wife. She wanted to avoid ruining the couple's marriage. That is how thoughtful she is.' But the incident has left the woman traumatised. She said that there were times 'when I still suffer flashbacks of that terrible instant'. Mr Lee said he severed his friendship with the businessman immediately after the incident but continued to receive SMS messages from him. He claimed: 'In his messages, he said it was not something he had planned. He pleaded with me not to tell his wife and elderly father. He was afraid that his father, who has a heart problem, would not be able to take the blow.' Mr Lee declined to disclose the businessman's details, saying that he had 'promised to close the case' with the 'settlement'. He added: 'I just want to say that even a 20-year relationship cannot withstand the temptation of lust and beauty.' Lawyer Doris Chia from Harry Elias Partnership said that while molest is a compoundable offence, rape is not. This means that notwithstanding the settlement between the perpetrator and his victim, the police could still intervene and charge the man. But that is only if a report has been made. A police spokesman said: 'Police will investigate into allegations of crime when it is reported, to establish if an offence has been committed. 'We advise victims of crime to come forward and provide information directly to us.' The penalty for rape is a jail sentence of up to 20 years.
