my gf was detained by ICA ...However, she was here previously to apply to solicit legally(Cat40) with another fake name passport ...I was advised by ICA Investigating officer try not to engage lawyer for her as it will bring no results for lighter sentence. Coz the mandatory is minimum 1 year. ...

My experience:-
1 year is the minimum sentence for ignoring ban or falsification of documents, so cannot get shorter, and no chance for appeal since she is guilty.
But can apply for early release - there is a scheme to get foreigners out of Singapore jails early, to save taxpayer money.

But now I have a question:
Can anyone recommend a lawyer who has been successful in a case like this; I (my girlfriend) am in the same situation, and hope to get early release from (longer) sentence...
Any suggestions?

What can they charge you with? They have no evidence - only your hearsay that is what happened, and they have no right to fingerprint you; even then, they have no evidence that the name change was illegal or that the previous documents forged. Maybe you changed name and nationality, but lost your papers?

But I think the immigration officer will be happy for a nice easy case to turn someone back - they probably will not want all the trouble of court case. PROBABLY.

But then maybe can apply for visa in advance. Nice letter from sponsor, nice explanation which is consistent with facts; if the explanation is OK, then probably immigration will ask for evidence before granting visa...

But if you not tell immigration officr on arrival then once in SIN, without declaring, then at the least, there is false declaration, maybe other problems as well...

true,true,thanks for your reply.whatever it is,they are getting more and more hi-tech.with the biometric scanner and prints system being implemented,i think even if you ask your ger go for plastic surgery or scarre her fingers,its also no use.....

bro,are u allowed to visit her.she is remanded at portsdown prison..usually its quite hard to appeal for parole or early release coz they are entitled to remission off their max sentenced based on gd behaviours.i feel that getting a local lawyer doesnt really helps much,u can seek thai consulate for help..try all avenues.maybe u should be more concerned of life after she is released....

This is a Law by Law area , we should do things step by step . Dont subject anyone to unnecessary danger .

Thing will be processed and done in a Process Flow chart and there s not much KC around us. Dont ever beg for KC or mercury , cos this is very painful before we can make ourself " HAPPY "

Back to main point , I think you can search for the " Penal Code " . Check which category of personnel he / she belongs to ? After that you maybe check the Max and min sents. Simple rite ?? Dont guess ,The Parrot will act and propose the sents accordinglu, So final say will be that person who is wearing a " WIG " to give Max or Min . Consecutively or Concurrently pending No.s of sents.

I agree with this advice. Its a gamble man. If you dun give them a chance to charge you, there won't be any sentence. There is a reason why there is a section asking "Have you been into singapore using a different name/passport" on the declaration card. Use it for good purpose

Talking about rules and regulations, there is a clause stating that anyone who used to or currently living off prostitution are categorized under "Prohibited Immigrants", this includes OKTs & Gals. OKTs as in the unlicensed ones.

Specifically, I want to request deportation mid-way through sentence, rather than wasting tax-payer money on time in Changi; but need to present justification for why will not re-offend, etc. I think no chance of re-offending, since caught once by fingerprints, caught every time...
Also, want to apply for lifting the ban - again, need to tell a good story; maybe no chance, but very inconvenient she cannot come to Singapore...

So I keep looking for lawyer.
She is in Changi, so can visit occasionally...very sad - prison life not healthy...

bro there is no chance u can request for deportation midway thru sentence,she will have to serve her time here,unless u can provide very good excuse to persuade the relevant authorities,even if it is based on medical reasons would be very hard too.but at least after u try u will feel at ease.as for trying to write in to life the ban after she is repatriated,u will have a case as she was already punished for her offence,u may use it as an advantage to her stand.it all depends on case by case basis. i wish u well. u are not the only one alone.no worries.
